This website is operated by Banda Marketing Group Inc., carrying on business as Chantal Banda Art. By placing an order through this website, you agree to these Terms and Conditions, together with our Shipping Policy, Refund Policy, Privacy Policy, and any other policies posted on this website.

All prices on this website are listed in Canadian dollars (CAD), unless otherwise stated.

All artwork sold through this website remains subject to availability. Because original paintings are one-of-a-kind, there may occasionally be rare situations involving prior sale, listing errors, pricing errors, or other circumstances that prevent an order from being fulfilled. We reserve the right to cancel any order at any time before the artwork has been shipped. If an order is cancelled after payment has been received, a full refund will be issued to the original method of payment.

When you purchase an original artwork, you are purchasing the physical work only. As per the Copyright Act, copyright and all reproduction rights in the artwork remain the property of the artist. Sale of this artwork transfers ownership of the physical work only, and does not transfer copyright or reproduction rights. The artist retains the right to reproduce and commercially benefit from the image of the artwork in any medium. Any transfer of copyright or reproduction rights must be made separately in writing.

We make every effort to present artwork images, colours, dimensions, and descriptions as accurately as possible. However, because screen settings and device displays vary, colours and appearance may differ slightly from how the artwork appears in person. Such minor variations do not constitute a defect.

From time to time, this website may also offer prints, calendars, gift cards, or digital products featuring the artist’s work. Unless otherwise stated, purchase of those items does not transfer copyright or reproduction rights. Digital products, if offered, are for personal, non-commercial use only and may not be copied, shared, resold, distributed, or modified without prior written permission.

Custom, commissioned, or personalized work is subject to separate discussion and approval. Unless otherwise agreed in writing, commissioned, custom, or personalized items are final sale and are not eligible for return or refund. Copyright in commissioned artwork remains with the artist unless expressly transferred in a separate written agreement signed by the artist.

Orders shipped outside Canada may be subject to customs duties, import taxes, brokerage fees, or other charges imposed by the destination country or courier. These charges are the responsibility of the buyer.
